Becoming a U.S. citizen is one of the most significant milestones a person can achieve. But the path to citizenship—officially known as naturalization—can feel overwhelming without the right guidance. From filing paperwork to sitting through a formal interview, there are several stages to navigate, each with its own requirements.
Are You Eligible to Apply?
Before diving into the application process, confirming your eligibility is essential. To qualify for naturalization, you generally must:
- Be at least 18 years old
- Have been a lawful permanent resident (green card holder) for at least 5 years (or 3 years if married to a U.S. citizen)
- Have lived in the state or USCIS district where you apply for at least 3 months
- Demonstrate continuous residence and physical presence in the U.S.
- Be able to read, write, and speak basic English
- Have good moral character
If your situation involves any complications—prior criminal records, extended periods abroad, or past immigration violations—consulting immigration lawyers in Salt Lake City or your local area before applying can help you avoid costly mistakes.
Filing Form N-400: Your Application for Naturalization
The process officially begins when you file Form N-400, the Application for Naturalization. This is the primary document USCIS uses to evaluate your eligibility.
What you’ll need to gather
Alongside the completed form, you’ll need to submit:
- A copy of your green card (front and back)
- Passport-style photos
- Filing fee (currently $725, which includes biometrics)
- Any supporting documents related to your marital status, military service, or criminal history (if applicable)
Take your time completing Form N-400. Errors or inconsistencies can delay processing or trigger a request for additional evidence. Review your answers carefully before submitting, and keep copies of everything you send.
The Biometrics Appointment
After USCIS receives your application, you’ll receive a notice scheduling your biometrics appointment at a local Application Support Center (ASC). This is a straightforward step, but it’s important.
What to bring
- Your biometrics appointment notice
- A valid government-issued photo ID (passport or green card)
At the appointment, USCIS staff will collect your fingerprints, photograph, and signature. This information is used to conduct background checks through the FBI. The appointment itself takes about 30 minutes. After it’s complete, you’ll wait for USCIS to schedule your naturalization interview.
The Naturalization Interview
This is often the most nerve-wracking part of the process—but preparation makes a significant difference. The interview takes place at your local USCIS field office and is conducted by an immigration officer.
What the interview covers
The officer will review your N-400 application with you, confirm your personal information, and ask about your background. You’ll also be tested on:
- English proficiency: You’ll need to demonstrate the ability to read, write, and speak basic English. The officer may ask you to read a sentence aloud or write one down.
- U.S. civics: You’ll be asked up to 10 questions from a pool of 100 civics questions covering American history and government. You need to answer at least 6 correctly to pass.
How to prepare
USCIS publishes the full list of 100 civics questions on their website—study all of them. Practice reading and writing simple English sentences. If you need accommodations due to age or disability, USCIS does provide exemptions in certain cases.
Navigating Common Legal Hurdles
Not every applicant sails through the process without hiccups. Some common issues include:
- Gaps in continuous residence: Extended trips abroad may disrupt your eligibility. Travel exceeding 6 months can raise red flags.
- Criminal history: Certain offenses can affect your “good moral character” requirement, sometimes permanently barring naturalization.
- Tax issues: Failing to file taxes as a permanent resident can create complications during the interview.
- Application errors: Missing signatures, incomplete sections, or inconsistent information can delay or derail your case.
If USCIS denies your application, you have the right to appeal. Understanding your legal options at each stage is critical—especially if your case involves any of the above complications.
The Oath of Allegiance Ceremony
Once your application is approved, you’ll be scheduled for the final and most meaningful step: the Oath of Allegiance ceremony.
What to expect
You’ll receive a ceremony notice with the date, time, and location. On the day:
- Bring your green card (you’ll surrender it)
- Bring your ceremony notice
- Bring a valid photo ID
At the ceremony, you’ll formally take the Oath of Allegiance to the United States, renouncing loyalty to any foreign country. Once completed, you’ll receive your Certificate of Naturalization—proof of your U.S. citizenship. From there, you can apply for a U.S. passport and register to vote.
Ceremonies can be judicial (held in a courtroom) or administrative (held at a USCIS office or community venue). Either way, it’s a moment worth celebrating.
